Will of Gershon Benbow
 
 
The State of Alabama
Montgomery County
 
I, Gershon Benbow, of the County and State aforesaid, being at this time at an advanced period of life and have a care to the disposition of the earthly substance with which it has been pleased God to bless me do for that purpose make and constitute this my last will and testament
 
1st  I will and bequeath to Stephen C Lane, Adam Hasson and Edward Benbow the following Negroes to wit Joe, Charles, Delsey, Abial and Amanda to have and to hold the said Negroes to the use of the said Stephen C Lane, Adam Hasson and Edward Benbow in trust to pay the hire and profits of the salves aforesaid to my Daughter, Elizabeth C Canty for her sold and separate use during her lifetime without the control of her husband should she hereafter marry or in any manner being subject or liable to his disposal contracts debts incumbrances or forfeitures and immediately from and after the death of the said Elizabeth C Canty in further trusts for issue of the said Elizabeth C Canty.  Also, 120 acres of land in section five T B R 13  -- also my horse and saddle.
 
2nd  I will and bequeath to Stephen C Lane, Adam Hasson and Edward Benbow Negroes to wit Josez, Abram, Frond, Clarisa and little Joe to have and to hold the said Negroes to the use said Stephen C Lane, Adam Hasson and Edward Benbow in trust to pay the hire and profit of the slaves aforesaid to my son Edward Benbow for his sole and separate use during his life time and after his death to his heirs.
 
3rd  I will and bequeath to Stephen C Lane, Adam Hasson and Edward Benbow-Negroes to wit Lesars, Peter, Milly, Eve and Mary to have and to hold the said Negroes to use of the said Stephen C Lane, Adam Hasson and Edward Benbow in trust to pay the hire and profit of the slaves aforesaid to my Daughter Ann E Cook for her sole and separate use during her lifetime without the control of her husband or in any manner being subject to liable to disposal contracts debts incumbrances or forfeitures and after the death of said Ann E Cook to issue of said Ann E Cook in fee simple
 
4th  I will and bequeath to Stephen C Lane, Adam Hasson and Edward Benbow Negroes to with Isaac, Daniel, Mary, Adalayr, Julian and Julia to have and to hold said Negroes to the use of the said Stephen C Lane, Adam Hasson and Edward Benbow in trust to pay the hire and profit of the slaves aforesaid to my Daughter Sarah M Brumby for her sole and separate use during her lifetime without the control of her husband or in any manner being subject to or liable to his disposal contracts debts incumbrances or forfeitures and after the death of the said Sarah M Brumby to her issue in fee simple
 
5th  I will and bequeath that my Executors herein named shall obtain of in their power my part of Evan Benbow Estate willed to me in South Carolina and make an equal distribution of the same between my four heirs in the same manner above mentioned
 
6th  I give and bequeath that my Executors herein named shall sell and dispose of all my land, horses, cattle and hogs, household and kitchen furniture, plantation tools for the payment of debts, any balance left of articles sold and equal distribution made between my four heirs this the 19th day of December in the year of our Lord one thousand eight hundred and thirty eight
